Welcome to Missionsavvy.com. Missionsavvy.com is owned and operated by Mission Savvy, LLC, a limited liability company organized and existing under the laws of the State of West Virginia. Any references herein to “Missionsavvy.com” shall be deemed to refer to Missionsavvy.com, the website located at www.missionsavvy.com, and/or Mission Savvy, LLC, as applicable. To ensure a safe, non-offensive environment for all of our users, we have established these Terms of Use and Service (the “Terms”). These Terms spell out what you can expect from us and what we expect from you and shall govern your use of the Missionsavvy.com website.

BY ACCESSING ANY AREAS OF MISSIONSAVVY.COM, YOU AGREE TO BE LEGALLY BOUND AND TO ABIDE BY THESE TERMS, WHICH, TOGETHER WITH THE POLICIES REFERENCED HEREIN, SHALL CONSTITUTE THE AGREEMENT BETWEEN YOU AND MISSIONSAVVY.COM (our “Agreement,” as more specifically defined in paragraph 20, below). ADDITIONALLY, YOUR ORDER PLACED ON THIS WEBSITE FURTHER SIGNIFIES YOUR ACCEPTANCE OF THESE TERMS AND WILLINGNESS TO BE BOUND BY THIS AGREEMENT. This Agreement constitutes a limited license to users of Missionsavvy.com and is solely for access and use of the Missionsavvy.com website. Missionsavvy.com may revoke such limited license at any time and in its sole discretion.

1. PRIVACY & SECURITY

Missionsavvy.com’s privacy policy, which is incorporated herein and made a part of our Agreement by reference, may be viewed at http://www.missionsavvy.com/privacy.

Missionsavvy.com reserves the right to modify its privacy policy in its sole discretion from time to time.

2. PAYMENT; TAXES

Missionsavvy.com accepts the following U.S. issued credit and debit cards:

When placing an order online, you will need the following information:

● The billing address to which the card’s statement is sent;

● The card number and expiration date; and

● The 3 or 4 digit security code found only on the card (i.e., the CVV2 code).

Credit card orders can be placed online over our 128 bit Secure Socket layer encrypted connection. You are responsible for maintaining the confidentiality of your bankcard account information and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

3. SHIPPING POLICIES

Missionsavvy.com ships orders within the 50 United States via UPS ground shipping. A flat fee of $6.95 will be applied for UPS ground shipping. This amount is subject to increase, in accordance with published UPS rates, and you agree to pay any increased shipping charge that might be applicable at the time of shipping. Depending on product availability, orders shipped usually arrive within 3 to 7 business days. However, Missionsavvy.com cannot guarantee, does not warrant, and assumes no responsibility for arrival times.

Shipping charges for international orders will be based upon item weight. International customers are responsible for all import duties and/or taxes.

UPS will not ship to post office boxes.

Accurate shipping address and phone number are required. Your signature may be required for delivery.

The risk of loss and title for all purchased items passes to you upon delivery to the carrier.

4. DESCRIPTIONS, COLORS, AND AVAILABILITY

Missionsavvy.com strives to maintain accurate product descriptions on its website. However, Missionsavvy.com does not warrant that its product descriptions or other website content is accurate, complete, reliable, current, or error-free.

Missionsavvy.com also strives to display as accurately as possible the colors of the products that it carries. However, because the actual colors displayed on your computer monitor depend on your computer system and other equipment outside the control of Missionsavvy.com, we cannot guarantee that the color displayed on your computer monitor will appear accurate.

Although Missionsavvy.com attempts to ensure the availability of the items displayed for sale on its website, we cannot guarantee and do not warrant the availability of any item at any time.

5. DELIVERY CONFIRMATION

Because many instances may occur at your delivery address that is beyond our control, you agree that any delivery confirmation provided by the carrier is deemed sufficient proof of delivery to the cardholder, even without a signature.

6. RETURN AND CANCELLATION POLICY

If you are unsatisfied with any product purchased from Missionsavvy.com, you may return it in unworn, like-new condition within fourteen (14) days from the date that you received your order for a refund according to the following terms.

(A) To obtain a refund, your return must be approved and postmarked no later than fourteen (14) days from the date that you received the order.

(B) To return a product for an exchange or refund, you will need to obtain a Return Authorization (“RA”) number by contacting the billing department at [telephone number or e-mail address].

(D) Missionsavvy.com will not process or refund packages marked “Return to Sender.”

(E) Refunds will be issued to the same credit card that was charged when ordering the product.

(F) Shipping charges and return shipping charges are not refundable in any case.

(G) To ensure that a refund is processed for you, please send returns only to the address provided along with your RA number. The RA number must be clearly written on the package that you are returning. MISSIONSAVVY.COM WILL NOT ACCEPT ANY PACKAGES WITHOUT A PROPER RA NUMBER.

Missionsavvy.com is not responsible for lost or stolen items. Missionsavvy.com recommends that all returned items be sent using some type of delivery confirmation system to ensure proper delivery.

After Missonsavvy.com receives your return, it can take several business days to process your refund. After a return is processed, it can take several additional business days for the return to be posted to your account, depending on your financial institution.

7. CHARGEBACK POLICY

All references to a “chargeback” refer to a reversal of a credit/debit card charge placed on Missionsavvy.com. If a credit is actually due, please contact us and we will gladly address the issue. If you feel that your credit/debit card was used fraudulently on Missionsavvy.com, please contact us immediately.

8. EXTERNAL WEBSITE LINKS; THIRD PARTY INTERACTIONS

Missionsavvy.com contains links to websites not under this company’s control. Although Missionsavvy.com attempts to choose those sites that will be helpful to its users, Missionsavvy.com is not responsible for the quality, safety, completeness, accuracy, or nature of the content of such external websites. Your electronic order confirmation, or any form of confirmation, does not signify our acceptance of your order. MISSIONSAVVY.COM RESERVES THE RIGHT TO ACCEPT OR DENY SHIPMENT TO ANYONE FOR ANY REASON. MISSIONSAVVY.COM RESERVES THE RIGHT TO REQUIRE ADDITIONAL INFORMATION BEFORE PROCESSING ANY ORDER. All other trademarks, service marks, copyrights, product names, company names, and logos appearing on Missionsavvy.com are the property of their respective owners.

15. TERMINATION OF USAGE

Missionsavvy.com may terminate your access, or suspend your access to all or part of Missionsavvy.com, without notice, for any conduct that Missionsavvy.com, in its sole discretion, believes is in violation of these Terms or any applicable law or is harmful to the interests of another user, a Provider, a service provider, or Missionsavvy.com.

16. USAGE BY MINORS

Missionsavvy.com cannot prohibit minors from visiting its website. Missionsavvy.com must rely on parents, guardians, and those responsible for supervising children under eighteen (18) years of age to decide which materials are appropriate for such children to view and/or purchase.

17. NOTICE

(A) Notice By Missionsavvy.com

In its sole discretion, Missionsavvy.com may give notice by means of a (i) general notice on the Missionsavvy.com website; (ii) electronic mail to your e-mail address on record in Missionsavvy.com’s account information; or (iii) by written communication sent by first class mail or pre-paid post to your address on record in Missionsavvy.com’s account information. Such notice shall be deemed to have been given upon the expiration of twenty-four (24) hours after mailing or posting (if sent by first class mail or pre-paid post) or immediately after sending (if sent by email).

(B) Notice By You

18. MODIFICATION OF TERMS

Missionsavvy.com reserves the right to modify these Terms and/or its policies relating to its products and services at any time, effective upon posting of an updated version of this Agreement on the Missionsavvy.com website. You are responsible for regularly reviewing this Agreement. Continued use of the Service after any such changes shall constitute your consent to such changes.

19. APPLICABLE LAW; CHOICE OF VENUE; MISCELLANEOUS

(A) These Terms and our Agreement shall be governed by the laws of the State of West Virginia and controlling United States federal law, without regard to the choice or conflicts of law provisions of any jurisdiction, and any disputes, actions, claims, or causes of action arising out of or in connection with this Agreement or the merchandise purchased and/or services provided shall be subject to the exclusive jurisdiction of the state and federal courts located in West Virginia.

(B) No joint venture, partnership, employment, or agency relationship exists between you and Missionsavvy.com as a result of this Agreement or use of the Missionsavvy.com website. The failure of Missionsavvy.com to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Missionsavvy.com in writing.

(C) The provisions of these Terms are intended to be severable. If for any reason any provision of these Terms shall be held invalid or unenforceable, in whole or in part, in any jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction.

(D) These Terms, including all documents referenced herein, represent the entire understanding between you and Missionsavvy.com regarding your relationship with Missionsavvy.com and supersedes any prior statements or representations. The aforementioned Terms are subject to change at any time without notice to you. YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND SERVICE BY ACCESSING AND/OR USING THE MISSIONSAVVY.COM WEBSITE.

20. DEFINITIONS

As used in this Agreement and in any Order Forms now or hereafter associated herewith: “Agreement” means these online Terms, any Order Forms, whether written or submitted online via the Missionsavvy.com website (located at www.missionsavvy.com), and any materials available on the Missionsavvy.com website specifically incorporated by reference herein, as such materials, including the terms of this Agreement, may be updated by Missionsavvy.com from time to time in its sole discretion; “Effective Date” means the date on which you first access this website and/or purchase any merchandise or services from this website; “Order Form(s)” means the form evidencing your purchase from this site and any subsequent order forms submitted online or in written form, each such Order Form to be incorporated into and to become a part of this Agreement (in the event of any conflict between the terms of this Agreement and the terms of any such Order Form, the terms of this Agreement shall prevail); “Missionsavvy.com” means Mission Savvy, LLC, a limited liability company organized and existing under the laws of the State of West Virginia and doing business as “Mission Savvy,” “Missionsavvy.com,” “www.missionsavvy.com,” and/or other trade names incorporating the “Mission Savvy” mark, together with its/their officers, directors, shareholders, employees, agents, and/or affiliated companies, as applicable.
